Privacy Policy

Titan Investigations adheres to the Code of Privacy as stated by the Council Of Private Investigators of Ontario. Titan Investigations protects personal information in accordance with the requirements of Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA), which defines standards of the collection, use and disclosure of personal information. Titan Investigations collects personal information on individuals where there is a potential contravention of the law, a breach of agreement or other circumstances that permit us to legally collect information under the laws of Canada. Titan Investigations has implemented the CPIO Code of Conduct, which complies with the principles outlined in the CSA Model Code for the Protection of Personal Information. 1. AccountabilityTitan Investigations acknowledges that it is responsible for personal information collected, information maintained by it or which is under its control. Information is protected with appropriate physical, technological, organizational safeguards and security measures.

 

Our organization has taken appropriate measures to develop procedures to: a. Protect personal information b. Receive and respond to complaints and inquiries c. Train our employees about policies and practices relating to the protection of personal information d. Distribute information explaining our policies and practices relating to the protection of personal information. Mr. Grace is designated within the organization as our Chief Privacy Officer, who may be responsible for coordinating our organization’s compliance with the following principles and can be contacted as follows: privacy@titaninvestigations.ca

 

2. Identifying PurposesTitan Investigations only collects personal information on individuals where there is a potential contravention of the law, a breach of agreement or other circumstances that sanction us to legally collect this information under the laws of Canada. All assignments received from our corporate, government, and other clients will be vetted to ensure their requests for information are compliant with PIPEDA. Personal information is collected for the sole purpose of providing investigative services to clients. Additional purposes for which personal information is collected or used by our organization may be identified at the time of collection. 3. Consent Titan Investigations will obtain consent from the appropriate for the collection, use or disclosure of personal information except where the law provides an exception (outlined in Section 7 of the Personal Information Protection and Electronics Act, S.C. 2000, c.5 (PIPEDA). Titan Investigations may obtain express consent for the collection; user disclosure of personal information, or when Titan Investigations determines that consent has been applied by the circumstances.

 

Express consent is specific authorization given by the individual to Titan Investigations, either orally or in writing. Implied consent is when Titan Investigations has not received a specific consent but the circumstances allow us to collect, use, or disclose personal information.

 

In most incidences, obtaining the knowledge and consent of individuals would defeat the purpose of an investigation, in particular with respect to a breach of an agreement or contravention of a law. Personal information will only be collected, used and disclosed by Titan Investigations without consent in accordance with Section 7 of the Personal Information Protection and Electronics Documents Act, S.C. 2000, c.5 (PIPEDA) or under other lawful means.

 

In this regard it should be noted that Titan Investigations is a member of The Council of Private Investigators and therefore: a. Is a member of an “investigative body” further to the regulation made pursuant to section 26(1)(a.01) of the said Act b. Is licensed and regulated by the ministry of the Solicitor General in Ontario An individual may withdraw his consent at any time upon reasonable notice, subject to legal or contractual restrictions, by contacting the privacy officer designated in principle 1. 4. Limiting CollectionTitan Investigations limits the collection of personal information to that which is necessary for the purposes identified by our organization. Personal information will only be collected by fair and legal means. The maintenance of personal will be conducted to insure the information is accurate, complete, and current as is required for the purposes for which it is to be used. 5. Limiting Use, Disclosure and RetentionPersonal information will not be collected, used or disclosed by Titan Investigations for purposes other than those for which it was originally obtained, except with the consent of the individual or as required by law. Personal information will be retained for various periods of time depending on the purpose for which the information was used and / or collected. Time periods might expand beyond the end of the particular relationship but only in order to provide adequate time to have access to the information in order to respond to any matter that might occur at a later time. When personal information is no longer needed, information will be deleted, destroyed or erased utilizing procedures and protocols to alter the information it to an unidentifiable form. 6. AccuracyPersonal information maintained by Titan Investigations shall be as correct, complete, and current as required for is intentional purpose. Titan Investigations objective is to diminish the likelihood that improper information might be used in a decision making process. The process for ensuring accuracy and compliance will involve: a. Initial collection from client b. Client will be asked to verify truthfulness and entirety c. Regular reviews; and d. Verifying accuracy by contacting third parties The identification of considerable error or omission will be corrected or amended to reflect the true accuracy of the information. Such amendments or corrections will be reported to parties who have had access to the information, where necessary. 7. SafeguardsTitan Investigations will protect all personal information under its charge in a way that is suitable to the context of the information. Security measures will include the encryption and secure erasure of electronic data, securing electronic data media with appropriate policies and accessories, network and Internet controls, securing physical sites with alarmed and controlled access to information within our office.

 

Personal information will be destroyed ensuring information cannot be retrieved after its disposal. This will include the shredding of documents prior to recycling and secure erasure of electronic data. Policies and procedures will be enforced to prevent unauthorized parties from gaining access to information after it’s disposal. 8. OpennessInformation regarding policies and protocol of the management of personal information under the control of Titan Investigations will be available upon specific request.

 

Inquiries should be directed to the Chief Policy Officer identified in principle 1. Denial of access to personal information might result for numerous as defined in principal 9. When lawful exceptions apply, our organization shall provide a detailed reason for the denial. 9. Individual AccessUpon request, an individual will be informed of the presence, use and discovery of his or her personal information that is under our management, and might be given access to and be allowed to dispute the accuracy and the completeness of that information.

 

Lawful exceptions that would prevent access, may include, but are not restricted to the following: 1. Personal information about another individual may be released. 2. Commercially private information might be disclosed. 3. An individual’s safety and / or security might be compromised. 4. Information was obtained without consent for the purposes related to an investigation of a breach or an agreement or contravention of a law or other lawful exemption. 5. The information was generated during the course of a formal dispute resolution process. 6. The information is protected by the Solicitor/Client privilege. 7. When restricted from providing this disclosure under Section 25 (1) of the Private Investigations and Security Guards Act; Revised Statutes of Ontario 1990 Chapter P.25. 10. ComplianceAn individual may address a dispute concerning Titan Investigations compliance with the principles governing the collection, use or disclosure of personal information by referring any inquiries to the Chief Privacy Officer.

 

Titan Investigations reserves the right to revise / modify this Privacy Statement at any time at its judgment by posting a new Privacy Statement at this location. Any changes to this Privacy Statement will be in compliance with applicable privacy laws.
